Work for Ukrainians in the EU: what applies since 24 February

Since 24 February hundreds of thousands of people from Ukraine have arrived in the EU. Many ask: may I work here, and what do I need? Here is an overview for Germany and Poland as of 18 March 2022. The rules are changing quickly; if in doubt, check with the responsible authority.

Temporary protection in the EU

On 4 March 2022 the Council of the EU activated temporary protection for the first time. It applies above all to Ukrainian nationals who lived in Ukraine before 24 February 2022 and to their family members. People who receive this protection get a right of residence and may work – without a lengthy asylum procedure.

Germany: residence and work

  • Entry: Ukrainian nationals may enter Germany without a visa. For the time being they do not initially need a residence permit to stay.
  • Residence permit: you can apply to the foreigners’ authority (Ausländerbehörde) for a residence permit under section 24 of the Residence Act. Until a decision is made, you usually receive a certificate.
  • Work: as soon as your document states that employment is permitted, you may work in Germany – employed by a German company.

Poland: special act of 12 March 2022

  • Ukrainian nationals who have come to Poland from Ukraine since 24 February 2022 are considered legally resident for 18 months.
  • They can apply for a Polish identification number (PESEL).
  • They may work. The employer must notify the local labour office within 14 days.

What this means for working in Germany through a Polish company

Someone working legally in Poland under the special act is employed by a Polish employer. For an assignment in Germany the posting rules then apply: employment contract, A1 certificate and – depending on residence status – a visa for Germany. Which documents these are is explained in Working in Germany: which documents you need. Clarify your status with your employer before you travel.

Beware of dubious offers

People in need are easy targets for dishonest agents. Do not accept work without a written contract, do not pay placement fees and never hand over your passport. Free advice is available from employment agencies and counselling centres for foreign workers, among others.
