Working with a Staffing Provider: How the Process Works
You need staff at short notice but have never worked with a staffing provider? Here is how the cooperation typically runs and what to watch for at each step.
Step 1: Define your needs
It starts with a short conversation: how many people do you need, for what work, from when and for how long? The more precisely you describe qualifications, working hours, location and special features such as shift work or work clothing, the better the offer will fit.
Step 2: Check the model and the licence
The key question is whether it is temporary agency work (Arbeitnehmerüberlassung) or a contract for work (Werkvertrag). For agency work, you as the client need certainty that the provider holds a valid licence under the AÜG. You can ask the Federal Employment Agency to confirm this. More on the distinction in Werkvertrag or temporary agency work.
Step 3: Sign the contract
The agency contract must be in writing and expressly state that it is temporary agency work. Duration, pay, hourly billing rate, notice periods and liability are key. Mind the statutory maximum assignment period of 18 months and the equal pay principle, which generally applies after nine months.
Step 4: Deployment and onboarding
Before day one, the work location, contact person, safety rules and induction should be settled. With agency work you direct the staff day to day, while the employer duties stay with the provider. Hours are recorded daily or weekly and confirmed by you. If workers come from other EU countries, the A1 certificate is an important point.
Step 5: Billing and feedback
Billing is based on confirmed timesheets. After the first few weeks, briefly review what works and what needs adjusting. That way team size and duration can be adapted flexibly.
Checklist for your first meeting
- Note number of people, type of work, start and duration
- Check the provider’s AÜG licence
- Clarify the contract model and billing rates
- Name contacts on both sides
- Agree on time recording and billing
