Framework Agreement with a Staffing Provider: What to Include
If you need staff regularly, a framework agreement saves time with every request. What matters is settling the right points clearly.
Service and form
Define whether it is recruitment, temporary agency work or a contract for work. The form determines instruction rights, liability and billing.
Prices and billing
- hourly rate or fixed price;
- surcharges for night, Sunday, holidays and overtime;
- payment terms and billing interval;
- adjustment when the minimum wage changes (2026: €13.90).
Proofs and compliance
- employment contract and social insurance registration;
- clearance certificates, in construction an exemption certificate under §48b EStG;
- working time records within 7 days, kept for 2 years;
- duty to comply with the minimum wage and the client’s right to inspect.
Liability and replacement
Settle replacement on absence, notice periods for the framework agreement and liability for damage. Remember the client is jointly liable for the minimum wage (§13 MiLoG with §14 AEntG).
Organisation
Accommodation, transport and workwear: who provides what, and who bears the costs?
