New Skilled Immigration Act: The Stages From November 2023
Germany is making it easier for skilled workers from non-EU countries to come. The law takes effect in three stages, the first in November 2023. We summarise what changes and what it means for employers.
The law at a glance
The law for the further development of skilled immigration was passed in summer 2023 and promulgated in August. It aims to make access to the German labour market easier for workers from countries outside the EU. It takes effect in three stages.
Stage 1: from 18 November 2023
The first stage brings changes to the EU Blue Card, among other things. Salary thresholds fall, and access for certain occupational groups, such as IT specialists, becomes easier. There are also new options for skilled workers with professional experience. The Western Balkans rule is expanded, and the time spent on recognition procedures is used better.
Stage 2: from 1 March 2024
The second stage is meant to make it easier for skilled workers with professional experience and a qualification gained abroad to enter. Recognition is simplified, and family reunification is also made easier.
Stage 3: from 1 June 2024
The third stage introduces the Chancenkarte (opportunity card). It is a points system for looking for work in Germany. The quota for the Western Balkans rule is also expanded.
What this means for employers
- You get more options for hiring skilled workers from third countries.
- Procedures remain complex: visa, recognition, approval by authorities and time for entry.
- Plan long lead times.
- Restrictions apply to temporary agency work: workers from third countries generally may not work through agency work.
What does not change
Different rules apply to EU citizens and people with temporary protection, for example from Ukraine. Minimum wage, working time and occupational safety apply to everyone as before. More on legally compliant employment in the article on agency work and equal pay.
Checklist
- Check whether the new routes fit your needs.
